A state appellate court handed the FutureGen Alliance a big victory Tuesday.

The court says it can proceed with an existing agreement that forces electricity providers to buy from the clean coal project in Morgan County. Alliance spokesman Lawrence Pacheco¬† says coal isn’t going away, so it’s important to use it cleanly.

“It’s important that there are technologies developed so [coal] can be used in a more clean fashion,” he says.

Pacheco says FutureGen is still on track for an end-of-the-year groundbreaking. It’s retrofitting an old coal power plant in Meredosia and will store carbon emissions underground.
